Will of Edward Harbroe (proved 12 Apr 1802)

 

The Last Will and

Testament of me Edward Harbroe of Ripley in the parish of Send in the County of Surry Surgeon and apothecary I in the First place I desire to be decently interred at the discretion of my  executors here in after named in the Chappel Yard of Ripley aforesaid whereas I have urrendered into the hands of the Lord of the Manor of Ripley and Send aforesaid all that my Copy hold or customary Messuage or Tenement out houses Garden and all and every their appartementes to the same belonging situate standing and being in Ripley Street aforesaid and which should by Copy of Court Role of the Lord of the said Manor To such use or uses I intents and purposes as I shall in and by my last Will and Testament In Writing Duly executes and attested Give Devise him it Direct or appoint the same Now I do hereby give and Devise unto my Brother in Law James Haslett of Kennington Lane in the County of Surry Timber Merchant my Brother James Harbroe of Rudgwick in the County of Sussex Surgeon and apothecary and Henry Harland of Ripley aforesaid Butcher all that my copy hold Messuage or Tenement Garden hereditaments and appartemantes show unto belonging and now in my Own occupation and also all that my One Moiety or half part  of and in all that Free hold Messuage or Tenement Farm Lands and hereditaments with their and every of their appartemantes called or known by the Name of Woodhouse Farm situate lying and being in the parish of Wisborough Green in the said County of Sussex and now in the Tenure or Occupation of his undetenants or assigns To hold to them the said James Haslet James Harbroe and Henry Harland In Trust Nevertheless and to the Intent and purpose only that they the said James Haslet James Harbroe and Henry Harland my said Trustees and the Survivors or Survivor of them Do and shall as soon as conveniently they can after my decease Sell Surrender Convey and Dispose of the said Copyhold and Freehold Messuages or Tenements Lands and promises with their and every of their apparts to the best purchasor or purchasors and for the most money that can be gotten for the said and that the receipt or receipts of my said Trustees or the Survivors or Survivor of them to such Purchasor or purchasors for the purchase Money to be given or paid for the same shall be a good and sufficient Discharge in Law to a purchase or purchasors thereof I also give and bequeath unto the said James Haslet James Harbroe and Henry Harland all and every my Goods Chattles Rights Credits and personal Estate whatsoever and wheresoever I in Trust nevertheless to sell and Dispose of all my said household Goods and Furniture (Except to late Linen in and my wearing apparel) and the Monies arising from the sale thereof together with the Monies arising from the sale of my said copyhold and Freehold Estates and all other my personal Estate whatsoever I in the First place to pay all my Just Debts Firm or as Expences and proving this my Will and from and after payment thereof I order and Direct the residue of the said Monies which shall be their residueing in my said Trustees hands to be put and placed out at Interest in their Names or the Names of the Survivors or Survivor of them in some publick Stock Bank or Fund or otherwise upon some other good and sufficient security or security’s with Full Power and authority for them my said Trustees and the Survivors or Survivor of them or the Executors or administrators of such Survivor at any time or times to call in remorc and new place out the same in such manner as they my said Trustees or the Survivors or Survivor of them or the Executors or administrators of such Survivor shall think fit and proper so as the best anual Interest be made thereof as conveniently may be without lessening the Principal and my Will and meaning is and I So hereby Order and Direct that my said Trustees and the Survivors or Survivor of them or the Executors or administrators of such Survivor shall have receive and take from time to time all the Interest and produce of the said Monies so to be put and placed out at Interest as aforesaid and to pay and apply the same or so much thereof as they shall think proper and necessary for and towards the Cloathing Education Maintenance and bringing up of my three Children Edward Harbroe John Harbroe and Louisa Harbroe until they shall have severally and  respectively attained to his her or their age or ages of twenty one years then I give and bequeath unto my Eldest son Edward Harbroe One third part or share of my said personal Estate then Remaining in

my said Trustees hands one other third part thereof I give to my said son John Harbroe and the remaining third part thereof I give to my said Daughter Louisa Harbroe But in case any or either of my said three children shall happen to die before his her or their said age or ages of twenty one years without lawful Issue then the third part or share of him her or their so dying shall go to and be paid to the Survivors of them equally share and share alike and if but one child then living then I order and Direct the whole to be paid to such only child and my will and Intent Further is that in case my said Trustees or the Survivors or Survivor of them shall think it expedient and proper for my said two Sons Edward and John to be put and placed out an apprentice to any Trade profession or Business then I do hereby order and Impower my said Trustees or the Survivors or Survivor of them to sell out and Transfer so much stock or call in such other Security so as to enable them to raise such Sum of money as they or the survivors or survivor of them shall think necessary and advisable to be raised and paid in putting out my said sons apprentice but such Sum or sums so raised and paid to be deemed and taken as part of his or their part or share of his or their Fortune and I do hereby Also Order and Direct that my said Trustees James Haslet James Harbroe and Henry Harland shall not be answerable the Owe for the other of them for any monies actually received by or Come to the hands of the other of them or for any monies that shall or may be casually lost by any security proving defective without his or their wilful Omission Neglect or Default but each of them for his Own Acts Deeds Neglect and Receipts Only and Further that my said Trustees be paid and at Liberty to retain out of any Monies which shall come to their hands all such costs charges and Expences as they or either of them shall be at or put unto in and about the Execution of the Trusts hereby in them reposed. I also give to my said Trustees a Mourning Ring oath as an acknowledgment for their Trouble And Lastly I Do hereby make Nominate Constitute and appoint the said James Haslet James Harbroe and Henry Harland Trustees and Executors of this my said will and I do hereby revoke make null and void all former or other will or wills by me of any time hereto fore made In Witness whereof

I have to this my said last Will and Testament contained in three sheets of papers of my hand to the First and second sheets and my hand and soal to the the third and last sheet thereof this Fourth Day of August in the year of our Lord One thousand Seven hundred and Ninety Four. Edward Harbroe

This Will was proved at London the twelfth Day of April in the year of Our Lord One thousand and Eight hundred and two before the Worshipful George Ogilvie Doctor of Laws and Surrogate of the Right honorable Sir William Wynne Knight Doctor of Laws Master Keeper and ommissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of James Harbroe the Brother and Henry Harland the surviving executors named in the said will to whom Administration was

granted of all and singular the Goods Chattles and Credits of the Deceased having been First Sworn Duly to administer
